1. Scope and General Provisions
    These Terms of Service govern all service agreements concluded via www.retrofitflow.com between Retrofitflow (hereinafter referred to as the Service Provider, We, or Us) and consumers or business clients (hereinafter referred to as the Customer or You) for old pipe removal and renovation services. By booking our on-site services, you agree to be bound by these terms. Deviating terms from the Customer are not recognized unless explicitly agreed to in writing.
  2. Service Offerings and Booking Process
    Retrofitflow provides on-site residential and commercial pipe removal and renovation services. All service descriptions displayed on our website are invitations to treat and do not constitute a binding legal offer.

Deposit and Booking: To secure an on-site appointment, customers are required to pay a booking deposit online via our authorized payment processor. The remaining balance for the service is settled according to the agreed quotation following the initial on-site assessment.

Contract Formation: A binding service contract is established only when we send an email booking confirmation following the receipt of the required deposit, or when we commence the requested on-site service execution.

  1. Pricing and Payment Terms

Deposit Requirement: The online booking deposit is payable immediately upon reservation through our integrated payment system.

Final Payment: The outstanding balance for completed services is due upon completion of the on-site work, payable via the agreed payment methods. In the event of payment default, statutory default interest and reminder fees shall apply in accordance with German Civil Code provisions.

  1. Right of Withdrawal for Consumers
    If you contract our services as a consumer residing within the European Union, you are entitled to a statutory right of withdrawal under the following terms:

Withdrawal Period: You have the right to withdraw from this contract within 14 days from the day of the conclusion of the contract without giving any reason.

Exercise of Withdrawal: To exercise your right of withdrawal, you must inform us (Retrofitflow, Grambker Heerstraße 93 A, 28719 Bremen, Germany, email: pipes@retrofitflow.com) of your decision by means of a clear statement (e.g., a letter sent by post or email).

Premature Expiry of Withdrawal Right: For service contracts, the right of withdrawal expires prematurely if the Service Provider has performed the service in full and has only begun execution after the consumer has given explicit prior consent and simultaneously acknowledged that they lose their right of withdrawal once the contract has been fully performed by the Service Provider.

Effect of Withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed about your decision to withdraw.

  1. Customer Obligations and Access Requirements
    Site Access: The Customer must ensure unobstructed physical access to the relevant work areas, water shut-off valves, and structural pipe networks at the scheduled appointment time.

Accurate Information: The Customer warrants that all provided property details, structural disclosures, and contact information are accurate. Retrofitflow shall not be held liable for delays or adjustments required due to inaccurate site disclosures.

Utilities: The Customer must ensure that necessary utilities, such as electricity and functional water supply points, are accessible on-site during the execution of the services.

  1. Cancellation and Rescheduling Policy
    Customer Rescheduling: Appointments may be rescheduled without penalty if requested at least 48 hours prior to the scheduled on-site arrival time.

Cancellation Terms: Cancellations made by the Customer less than forty-eight (48) hours prior to the scheduled appointment may result in the forfeiture of the online booking deposit to cover incurred operational and scheduling allocations.

Provider Rescheduling: Retrofitflow reserves the right to reschedule appointments due to unforeseen technical impediments, severe weather, or force majeure events. Customers will be notified promptly, and alternative arrangements will be scheduled.

  1. Limitation of Liability and Statutory Warranties
    Statutory Rights: Statutory warranty rights under German and European consumer protection laws apply to all services rendered.

Limitation of Liability: Retrofitflow is liable for intentional acts and gross negligence without limitation. For ordinary negligence, our liability is restricted to foreseeable contractual damages typical for this type of service. This limitation does not apply to injury to life, limb, or health, or breaches of essential contractual obligations.

Technical Disclaimer: While we apply professional standards to all removal and renovation tasks, structural anomalies inherent to aging infrastructure may require secondary interventions. No guarantee is provided for pre-existing structural decay outside the immediate scope of the contracted pipe removal work.

  1. Data Protection and Privacy
    We collect, process, and store personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and applicable German federal data protection laws. Data provided during the booking process is utilized strictly for contract fulfillment, appointment scheduling, and statutory compliance. Customer data is never shared with unauthorized third parties.
  2. Governing Law and Dispute Resolution
    Applicable Law: These Terms of Service and all legal relations between Retrofitflow and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), provided that mandatory consumer protection regulations of the Customer’s EU member state of residence remain unaffected.

Dispute Resolution: The European Commission provides a platform for Online Dispute Resolution (ODR), accessible at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

  1. Final Provisions
    Should any provision of these Terms of Service be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that closely reflects the commercial intent and purpose of the original clause.
